The latest replies by Minister for Safety and Security to
parliamentary questions about the renewal of gun licences disclose
that the hideously costly implementation of the Firearms Control Act
has degenerated into a disgraceful sham.
Taxpayers have a right to know how chaotic affairs are at the
Central Firearms Register. A forensic audit of the implementation of
the Firearms Control Act is years overdue. The FCA has to be
abandoned, urgently, as happened to its Canadian blueprint.
The shambolic state of the CFR is a by-product of a complete lack of
parliamentary oversight, the Amended FCA, the product of ANC
The Central Firearms Register, the disgraced Commissioner of the
SAPS and the Minister for Safety and Security set a terrible example
to criminals by refusing to abide by the Constitution or provisions
in the Firearms Control Act they disagree with, like paying
compensation for firearms!
Lies and statistics
According to the Minister there were 85 154 applications for
competency certificates in 2005 of which 13 455 were granted while
there were 126 404 licence renewal applications of which 4 089 were
approved and 2 865 refused, a refusal rate of 41%. Five percent of
renewal applications were finalised.
Who knows what happened to the backlog? In 2006 there were 152 168
applications for competency certificates of which 75 820 were
granted while there were 215 931 licence renewal applications of
which 48 159 were approved and 5 669 refused, a refusal rate of 11%.

In 2007 there were 182 661 applications for competency certificates
of which 102 621 were granted while there were 259 393 licence
renewal applications of which 125 248 were approved and 11 258
refused, a refusal rate of 9%. According to the Minister's figures,
52% of renewal applications were finalised.
Does anyone believe him? One thing is clear: the pathetic number of
completed applications proves the CFR cannot administer the Act,
even in the complete absence of new licence applications.
Whatever the true figures are, this is spectacular non-compliance,
in anyone's book. More than two million gun owners should have
complied with the farce of firearms licence renewal by December last
D-Day looms just over a year away. D-Day being Disarmament Day. At
the end of July next year, this country's 2.5million gun owners
should have completed the process of firearms licence renewal.
Gunowners are not idiots: The Firearms Control Act was always
confiscatory in intent; it is unconstitutional and unimplementable.
That 2005 refusal rate of 70% speaks for itself.
What are the SAPS going to do with those of us who refuse to comply
with the unimplementable, unconstitutional FCA, come 1 August 2009?
Lock us all up? Drag two million gun owners off to jail with the
world watching and the World Cup around the corner?
The Citizen published the Opinion of Senior Counsel linked to the
Directorate of Public Prosecutions a while ago, noting that licences
granted under the old Arms and Ammunition Act are valid for life and
mandato renewal unconstitutional.
Renewal of gun licences is a scam, a massive bluff. In the process,
our Constitution got trampled.
